What is Section 65?
In instances where a creditor has obtained a judgment against you and you are unable to pay the full outstanding amount or you do not own enough movable property to satisfy the judgment amount, the creditor can launch Section 65 proceedings against you.
You will receive a notice in terms of Section 65A of the Magistrates Court Act notifying you of a date to appear in Court for a financial enquiry. The Court will assess your financial situation and your ability to make monthly payments towards the judgment amount. This can be a nerve-racking experience, having to appear in court by yourself and attempting to negotiate with an attorney or advocate representing your creditor.
